IRS pays illegals $4.2 billion while stalling tea parties

WASHINGTON, D.C. — While harrying and stalling tea party groups seeking nonprofit status, the Internal Revenue Service mailed $4.2 billion in child-credit checks to undocumented immigrants.

Critics say midlevel IRS bureaucrats continue to abuse the Additional Child Tax Credit program by dispensing $1,000 checks to families in this country illegally.

“The law needs clarification that undocumented immigrants are not eligible,” Sen. Charles Grassley, R-Iowa, told Watchdog.org in a statement.

To make Congress’ intent clear – that only legal U.S. residents are entitled to ACTC credits — Grassley co-sponsored a clarifying amendment with Sen. Mike Enzi, R-Wy.

“Unfortunately, the majority leader (Harry Reid, D-Nev.) cut off debate, so we weren’t given the chance to offer our amendment,” said Grassley, the top Republican on the Senate Judiciary Committee.

The IRS’ practice of paying out billions to undocumented-immigrant families never received full congressional scrutiny, said David North, a fellow at the enforcement-oriented Center for Immigration Studies.

“I’ve been in government and I know kind of how these things work out,” North told the Washington Times.

“It struck me that (GS) 15s and 16s got together at some point and decided this is how we should handle it, and it stuck,” said North, who wrote “Paying Illegals to Stay,” an analysis of how benefit programs increase illegal immigration.

The IRS has said it doesn’t believe the ACTC law allows the agency to deny payment to undocumented immigrants.

Watchdog reported in June that disbursement of ACTC credits has grown rapidly — and suspiciously — with increased issuance of Individual Taxpayer Identification Numbers as substitutes for Social Security numbers.

ITIN holders are not required to prove legal residency, and ITIN applications are running at the rate of 1 million a year.

Federal investigators identified one address in Atlanta where 23,994 ITIN refunds totaling  $46,378,040 were delivered. A single bank account there received 8,393 refunds.

Records indicate that undocumented immigrants in Virginia received $87.9 million in ACTC cash from the IRS. Watchdog reported that $163,711 went to a single address in the tiny eastern shore town of Parksley.

In lightly populated Iowa, Grassley’s home state, undocumented immigrants got an estimated $30 million.

With an average of 15 percent of ACTC refunds directed to undocumented households nationally, North calculates that roughly half of the money went to ITIN holders who paid “little or no income taxes.”

An audit by the Treasury Inspector General for Tax Administration stated:

“We believe legislation is needed to clarify whether or not refundable tax credits such as the ACTC may be paid to filers without a Social Security number. Such a legislative change could result in cost savings to the federal government of $1.8 billion annually.

“As it now stands, the payment of federal funds through this tax benefit appears to provide additional incentive for aliens to enter, reside and work in the U.S. without authorization, which contradicts federal law and policy to remove such incentives.”

The recommendations of that audit, conducted in 2009, have yet to be acted on.

Meantime, the IRS continues to be dogged by controversy over its handling of tax-exempt requests by tea party groups and other conservative organizations.

Judicial Watch this month filed a Freedom of Information lawsuit against the agency asking the District Court for the District of Columbia to compel the IRS to produce records of all communications relating to the review process for organizations seeking 501(c)(4) non-profit status since Jan. 1, 2010.

On May 14, the Treasury inspector general concluded the IRS had singled out groups with conservative-sounding terms such as “patriot” and “tea party” in their titles when applying for tax-exempt status.

I would bet, but can’t verify, that they receive other benies too. Who is making out better – an American citizen on the books or these guys? And why are people still feeling sorry for them?

First off, NO ONE without a Social Security number, proof of citizenship and residence, should be allowed to file a tax return, let along receive any form of credit/refund! This is beyond ridiculous!     Why are multiple refunds being allowed to single addresses and bank accounts? Why are there no measures in place to check on this type of activity? No wonder they can afford better cars and more everything than we can. To make matters worse, it’s OUR money paying for it!

    Nice. Maybe I should go back to being a citizen of Germany, quit my job and just start having a ton of kids. Misuse of EBT during glitches, free this, free that. It seems like the more I work, the more that gets taken from me to give to people who contribute nothing of value to society. If people would give back (i.e. by volunteering to pick up trash or something), I would feel a little better. I just get so bent out of shape when I continue to see people misuse and/or abuse the system, when people who bust their butts get ripped off.
    I am not against immigration, as I was not born in the US; I just feel that if you plan on moving here – become documented and legal. I just need to stop reading articles – just almost puts a damper on my day :)

    This is why I stopped helping or donating in America. My tax dollars alone are enough and that’s my “donation.” I’m legal and I don’t get a dime of that tax refund for my kid, yet some illegal gets a $1000 check on my tax dollars. WTF is up with that?     It is abuses like this that leave me wanting 2 things:

    1. Fire the IRS every single one of them (okay I know all are not corrupt, I get that.)

    2. Send every single ILLEGAL home on their dime, and actually drop them off at the southern most part of South America (Okay, I get some really love this country and want to be a citizen, they need to go back on their own and go through the process, the others if they are deported by us, forget any path to citizenship. Forget the Dream Act I think that is about the children, no to those who do not come in legally and stay legal.)

    Didn’t use to feel this way, but have had enough and saying to my representatives enough! Fortunately we mostly agree on both these issues.

Like for the earthquake in Haiti – they sent so much of our money to them (and no one still knows today where it all went) so when I got calls for donations I explained that I already gave.     It is time to abolish the income tax, and with it the IRS. Go to a national sales tax. Just imagine the tax revenues that could be collected from all those “illegal” activities like drug dealing, gambling, etc. Those crooks buy cars and big screen TVs and iPhones and jewelry – let’s collect a national sales tax and make them contribute. Add to that the unbelievable savings in hours lost preparing tax returns and you have a virtual windfall that will vault this economy forward.

    It’s just common sense – penalize consumption, not achievement, collect taxes from criminals, save all the law-abiding folks lots of time and aggravation. What’s not to like?

    The problem to begin with is the ITIN (Individual Taxpayer Identification Number) department in Austin, TX. Since illegals don’t have a valid SSN (even though they always work under fake one or someone else’s) the government back in the 1990’s created the ITIN dept so illegals could do taxes. That is the only purpose of the ITIN number and since its creation illegals have found a loophole in the additional child tax credit.

    To solicit an ITIN number for dependents (children) the department requires that either a passport or in its place a birth certificate, school record, medical record, shot record can be substituted. The problem is all of these documents are foreign issued and not one single piece of proof that these kids are here in the US residing at the same address of the taxpayer is required. These dependents are usually listed as nieces or nephews and live in Mexico. I have even seen people from Guatemala, El Salvador, Honduras and Nicaragua claiming Mexican children as dependents. The taxpayers come in our office with a handful of ITIN numbers for kids they’ve probably never even seen.

    The question of whether it’s the responsibility of the tax preparer or the IRS to determine eligibility of dependents has been brought up. Some IRS agents have questioned whether the kids meet the presence test and of course they don’t, but it someone comes in with ITIN numbers doesn’t that mean they have already be pre-qualified to do taxes? Shouldn’t the ITIN department be the ones who ask for proof those kids are here? They certainly make a lot more money than tax preparers do.

    We thought at the beginning of last tax season that clients would not be able to claim kids who are not here. We had heard that the IRS would send a letter to illegals using dependents with ITINs asking for proof those kids are here before issuing their large refund, but that didn’t happen at all. Everyone got their money with refunds averaging between 5 and 10 thousand dollars. How hard would it be to send a letter asking for proof before just simply giving away more money than most Americans get in refunds?

    A local reporter named Bob Segall from NBC’s WTHR broke this story in 2012 and hit the nail on the head. His report was spot on and what amazes me is that this story has not made it to the major media outlets except for Fox News mentioning once or twice.     This piece is ill written with a diferent intent. I do not think undocumented people can claim an ACTC for undocumented children. If the undocumented person “FILING A TAX RETURN” or “PAYING TAXES” is claiming an ACTC credit is for a US citizen child not undocumented child.

    Is it possible for the House of Representatives to control purse-strings to the degree of stopping such errant distribution? What if Senator Grassley brings enough attention to it with the stalwarts in the Senate like Cruz, Paul and Lee? Perhaps a few more would join in and action initiated by the House. I wish I knew!
    I think Democrats would overlook and argue for this wasteful policy, it seems exactly what they want. Every moment we discover more and more bogus use of our tax dollars, then it’s simple to rationalize why the horrendous debt of our country. It’s Obama regime abuse of citizens taxes!

    Medicare or other federal benefits, except for emergency medical
    treatment in hospitals. And since passage of the 1996 welfare reform
    law, they have been ineligible for the refundable portion of the Earned
    Income Tax Credit as well.
    At that time, Congress required that a valid Social Security number
    be filed for those claiming the EITC, and that requirement saved an estimated $300 million a year. But Congress did not enact a similar requirement when it created the child tax credit, which went into effect in tax year 1998 at $400 per child, and was increased to $500 the following year.
    Initially the credit wasn’t refundable in most cases (only for
    families who had three or more children and who also met certain income
    tests). So the issue of illegal workers claiming credits did not arise
    at first. But the 2001 Bush tax cuts made more parents eligible for
    refundable credits, and increased the amount in steps to $1,000 per
    child.
    So by 2005, the recent IG report said, 796,000 persons without valid
    Social Security numbers claimed refundable child credits totaling $924
    million, and in 2008, these claims had risen to 1,526,276 persons
    claiming $2.1 billion in refunds.”

    Today, went through the drive thru at McD’s. The person taking the orders no hablas Englais muy bueno. So when I got to the payment window I mentioned that the person taking the orders should be a good English speaker. She said to talk to the manager at the next window. The manager turned out to no hablas Englais muy bueno. So I mentioned anyway that it would help if the person taking the orders spoke English as a first language. The guy was standing there & in a heavy accent said ‘Really?’ So I responded with ‘En serio.’ He walked off & the person who handed me my food was also not of this country.
    These are jobs that teens & college students should be holding! If the illegal aliens and their anchor babies were sent back to their own countries, taking NOTHING but what has been completely paid for (anything that they are making payments on stays & maybe banks & companies will think twice about next time).

    Since the Additional Child Tax Credit is filed when filing your income tax returns, I find it hard to credit this story with any truth to the number of dollars supposedly going to illegals, since by nature of being illegal they DO NOT file income tax returns. Further it is not a check cut independent of your income tax return so again how would it be tracked. Third, living in a place with a high number of illegal immigrants, I know that the majority do not have bank accounts here in the US, hence the prosperity of rip off check cashing stores!

    Yep, my American Dream went down the toilet in 2012, couldn’t believe that after 40 years of being a responsible home owner, and my husband a loyal employee that I would go through what we did last year; which was nothing more than ACA effect early, and the payout for the banks that destroyed property value.

    So I can understand your feeling of loosing the A.D. and concern for our children and in my case grandchildren. Debt repayment looks impossible even in their life time, scary.

    I want to see our jobs come back to this country, our money, and a balanced budget.

    Enough entitlements and jobs to people who know they are here illegally and think that is okay! It is not. It is time to enforce the laws already on the books. And when they get ready to bus illegals out and other illegals block or chain themselves in protest, then just have some more buses ready and head on down the road with them.

    Can you tell I am a little tired of our upside down legality!

    This is legitimate. I worked with the IRS, and the filer basically gets ITINs for children from other countries by using their school records. They then file the return claiming the ACTC for those ITINs, and they can say that the children were living in the US since 5 years ago. 2k per child, 5 children, 10k x 5 years = 50k up front. 10k per child.

    Now if you take 4.2 billion and divide it by 10k, you get 420k children, which is less than half of one million ITINs that were assigned. In other words, less than half of the ITINs were claiming the ACTCs, which is a reasonable statistic. How many of these are truly fraudulent though compared to those that weren’t? Maybe not the full 4.2 billion, but certainly a great portion of it. Regardless, no evidence was provided that the children are currently residing in the US, and that is the bigger issue.

    Funny, I accidentally switched the two middle numbers on one of my sons’ SS# one year on my tax return. The IRS was none too pleased, to put it mildly. They required his SS card etc… So, I want to know how these illegals are filing for tax subsidies when they don’t have SS #’s for themselves much less the kids they list as dependents?

    Yes, if some people say or some people think….. well then it must be true, except for the fact the one cannot get a child credit if the parent does not have a SS#, just minor details of course but it got you riled up now didn’t it.
