Seattle uses eminent domain to turn a parking lot into a parking lot

Seattle’s city council voted unanimously Monday to use eminent domain to take private property. They say they must seize the private property, which is currently being used as a parking lot, in order to turn it into … a parking lot. (Here is the link to the original notice). Local station Q13Foxnews discussed this story here.

In addition to eminent domain abuse, the City of Seattle has recently been in the news for hiding public records, and sinking the farm boat. The common thread among all three of these stories is that, in Seattle, central planning takes priority over people. In this case, they decided it was critically important to seize a parking lot from its 103-year-old owner so that it can be a parking lot. At least this is their stated justification.

    I read a story years ago about a community with a lot of beach-front property that used eminent domain to seize beach houses and their property. The problem was that many of the houses were in great condition, but were so old that residents in them had long-ago paid off their mortgages and the amount of tax revenue was very low. The government wanted to replace the houses with properties that could tax at a much, much higher rate. The result? Instead of paying the occupants a fair market price of close to 1.3 million dollars a piece (which was the average appraised value), the local government contended in court that just compensation could be satisfied by giving the residents an alternative home with the same square footage. That ended up with them being forced out of their homes they owned lock, stock and barrel and placed in a $280,000 high-rise condo miles away from the beach….all with no additional monetary compensation. Eminent domain laws are like any other law the government is refusing to abide by.

    One thing i wonder if anyone else noticed about this story is that the name of the parking lot is “Republic Parking Systems” with red white & blue on the sign as can be seen in the Q13Foxnews video link above. Could this move be partially motivated by a liberal bias against anything with the words republic or republican. It would be interesting if the reporting would dig deeper to see if she was ever approached at any point to change the name.

Al I remember was watching footage of one of the local government officials getting grilled by a reporter during an interview and the official poo-pooing the notion of any kind of unfairness in the process, he was saying words to the effect of “What, we’re giving them a free condo for their troubles, how is that not fair?”. I was still living in Detroit at the time and all I remember was my father getting so angry that he nearly kicked the TV over and stormed out of the room.

    Something like this happened in Denver when the Rockies baseball team moved downtown. You know they lifted up downtrodden downtown? The city imminent domained property for parking lots close to the stadium.
    One family had owned their property for a long time,these owners wanted to keep the property and make it a parking. The city took it, approx 1992, I don’t know who owns the property now probably the rockies. They can’t play baseball
    but they collect money from the parking lot?

    I read through the documents linked in the article. It seems Seattle has a big road project going on downtown that is disrupting on street parking. In order to alleviate parking problems, they attempted to make deals with private lot owners to provide public parking at rates similar to on street parking. The owners would not agree to the deal, so, Seattle is exercising imminent domain over private lots in the construction area so tourists don’t get screwed by high parking rates. There were public meetings, direct contact, and newspaper notices all informing owners of the plan. Either she wouldn’t deal, or she didn’t know because she lives in Spokane. Either way, she is getting paid for her land.

    It is not the city’s role to make sure “tourists don’t get screwed by high parking rates” on private property. So private citizens cannot be in the parking lot business anymore because they might charge according to market rates? Who decides what “screwed” is besides the market? Private lots are the norm where I live and they compete pretty well. If the private owner charges too much no one will park there. If the city could get more for the spots (and the private citizens are getting more) then it’s the taxpayers who are getting “screwed”.

    Everyone is greedy. My wife wants a raise, too. Competition mostly, but other things as well, keep greed in check. Athletes, actors, CEOs, etc all have restraints and must, generally, provide services worth their pay. Corps have all sorts of plans to keep CEOs working for the stockholders – Apple recently announced a new method. In addition, if CEOs get too greedy corp raiders (e.g. Carl Ichan) takes over the company and fires management and boots the stock value. The scariest thing a CEO can hear is “Ichan is on the phone for you.”

    Government is greedy too, but has fewer restraints and is thus much more abusive. They can deceive w/o recourse. My city just got caught reducing yellow light times to raise revenue and doing this increases physical danger to its citizens.

The real story is that the City of Seattle is taking this property by abusing emiment domain, changing nothing about how it will be used, then after the fuss dies down the City of Seattle will sell the property to some of their politically connected friends to make a fortune one with a planned development. It is a scam… and the taxpayers fund it.

    Have you considered that the eminent domain “taking” of this property might actually be to the advantage of this 103 year old person? For example if the city were to buy the parcel out right the proceeds of sale would immediately be subject to capital gains tax or to defer paying the tax the seller would have to do a like kind exchange. However, if the City “takes” the property thorugh imminent domain the owner or his estate gets something like a 5 year deferal from capital gain tax in which to find a down leg like kind investment. Just something to think about.

    The ruling was based upon the greater good for the community. IE employment and tax revenue (economic development). In the long run everybody lost. Property owners forced to sell ( at a huge discount), the developer failed (bankrupt), the town lost the taxes from the home owners, no jobs were created, no buildings built, no economic improvement at all. So in this case the SCOTUS got it wrong.

    Using tax payer money for government to buy out businesses, and then turn a private business into “government” business, shows government is taxing and spending too much.

    This is a loser all around. The woman loses her business and income from it. The government loses a business and individual taxpayer and instead of a business being run for a profit, government will likely run it into the ground, with an overpaid government employee that will be more interested in not working since government won’t hold him accountable. In the meantime, taxpayers are out the fair market value for the lot, and lose on future tax revenue as well.

    Government doesn’t run anything well. It’s specialty is using force against citizens, rather than voluntary transactions that exist in a free market.

    About as smooth as the New London, CT vs Kelo eminent domain case where homes in New London, CT were purchased via eminent domain for economic development with one hold out. The hold out, Kelo, was even charged rent after 5 years of fighting the case! Pfizer was to expand their facility and the land was to go to a developer for $1 a year to build condos, shopping district, etc. Despite all the tax breaks, the developer’s plan fell through. A settlement to the home owners was made with significant more payout, Kelo’s home was physically moved at great expense and Kelo moved elsewhere in the state. Pfizer merged with another company and pulled out of New London laying off about 1,500 workers and saving them $400 million in taxes. It cost the city $78 million to demolish the homes only to sit in a vacant lot that now is holding debris from hurricane Sandy! Complete waste of time, energy, and tax payers money. Kelo’s fight saw two city council seats taken over by Kelo supporters and the fight continues to replace the rest. The city of New London is still sore from it’s wounds. Now we’ll see if the New London Groton Sub Base will close (almost did in 2005, was saved at the last moment) also Electric Boat has a factory where they manufacture hunter killer submarines as well. If those two close, New London will have little to no jobs nor income…

    Well tar is carbon, so the Global Warming taxes and regulations will be ridiculous and will raise the price dramatically. Transporting and storing will require specialized equipment. Make sure you have spill procedures and EPA registered plans on file.
    The feathers need to be organic and humanely farm raised. Make sure you are following Bird Flu mitigation procedures and do not stress the fowl in any way. Also make sure that you do not have any toxic runoff from your poultry farm. And that you have worker protection plans in place. Also that you are not employing any illegal aliens. And be sure that you register your facility with OSHA and that all Jobsite Protection Equipment is up to date and functional.

    Other than that, it’s a good plan!

    I am not familiar with this particular case, but I will comment just on what I have read above, and reply to your comment. The city is taking his property from him. They are compensating him for this taking. If he doesn’t want to sell his property to the city for the compensation offered, he is not freely selling his property. If he doesn’t want to take advantage of any supposed tax deferrels, that is his choice. This is his lot. He may enjoy going to the parking lot every day and collect payments.
    All this being said, perhaps this is the way he wants to sell his property, and this is just a scam concocted between him and the city so that he doesn’t have to pay exhorbitant taxes on the sale, I don’t know.

    Look-up the story of what they did on NW Market and 15th St. NW. They used eminent domain for a “monorail” station to get the property at that high-traffic intersection on the cheap. That fell through, so they sold the land. Those people had been collecting property at that intersection for decades, and had it ripped out from under them by the greedy Socialists. Sickening.

    Eminent domain is the taking of private land by the government for the supposed good of the public. Think of pushing a new freeway through farm country. The government is however required to pay fair market value for the taking. In most circumstances, such as freeway expansion the property owners reach a sales agreement before eminent domain comes into play. However what Seattle is doing does not make sense to take a parking lot to turn it into a parking lot.

However, basically, it refers to the legal taking of private property (usually land) for a “public use.” Traditionally, public uses would be for roads, military bases, schools, etc. For more detailed background, I would start here: to learn more.

    Frankly I don’t believe you, and I’ll add that you’ve not provided any evidence for your position other than your statement. Perhaps Seattle doesn’t pay its government employees well, or perhaps you feel your government pay is “for s**t” in which case I suggest look for another job to prove your statement is true, and which you will undoubtly will apply for (but do you have what it takes to get it?).

    I base my statements on research: e.g. which shows that state and local government workers on average, make 45% more than workers in private industry, based on Bureau of Labor statistcs. And they also show regional variations, and that for the Pacific region which includes Seattle, government workers on average make 59% more than those in the private sector. And you think that’s “for s**t”? If so, then get another job or abandon your delusion.

    The viaduct/tunnel construction resulted in loss of on street parking. The area is heavily dependent on tourism. Does the city allow the private lot owners to keep prices high and lose tourist traffic to businesses, or does the city buy out the lots and provide parking at rates similar to the lost on street parking? Seattle chose the latter to help the local businesses to the detriment of the lot owners.

    Thank the US Supreme Court, in Kelo v New London, wherein private land was condemned for public “purposes” of an otherwise private enterprise, expanding beyond the “public USE” wording of the Fifth Amendment.
