Seattle uses eminent domain to turn a parking lot into a parking lot

Seattle’s city council voted unanimously Monday to use eminent domain to take private property. They say they must seize the private property, which is currently being used as a parking lot, in order to turn it into … a parking lot. (Here is the link to the original notice). Local station Q13Foxnews discussed this story here.

In addition to eminent domain abuse, the City of Seattle has recently been in the news for hiding public records, and sinking the farm boat. The common thread among all three of these stories is that, in Seattle, central planning takes priority over people. In this case, they decided it was critically important to seize a parking lot from its 103-year-old owner so that it can be a parking lot. At least this is their stated justification.

I read a story years ago about a community with a lot of beach-front property that used eminent domain to seize beach houses and their property. The problem was that many of the houses were in great condition, but were so old that residents in them had long-ago paid off their mortgages and the amount of tax revenue was very low. The government wanted to replace the houses with properties that could tax at a much, much higher rate. The result? Instead of paying the occupants a fair market price of close to 1.3 million dollars a piece (which was the average appraised value), the local government contended in court that just compensation could be satisfied by giving the residents an alternative home with the same square footage. That ended up with them being forced out of their homes they owned lock, stock and barrel and placed in a $280,000 high-rise condo miles away from the beach….all with no additional monetary compensation. Eminent domain laws are like any other law the government is refusing to abide by.

That is why we no longer have a Supreme Court for the people. All we have in there now is a bunch of corporate stock owners whose interest is in themselves and supporting corporate America, and threw the people into the streets.

Remember when they wanted to take Justice David Souter’s farm? Here is what one of our jester’s stated:

“In his majority opinion, Justice John Paul Stevens said New London
could pursue private development under the Fifth Amendment, which allows
governments to take private property if the land is for public use. He
said the project the city has in mind promises to bring more jobs and
    revenue.
At least eight states — Arkansas, Florida, Illinois, Kentucky, Maine,
Montana, South Carolina and Washington — forbid the use of eminent
domain for economic development unless it is to eliminate blight.”

Here is the link to the whole story. How does Seattle justify their actions? http://www.nbcnews.com/id/8406056/#.Umkp1xD-sTY

This article shows just how much the Supreme Court of Jesters are in the back pockets of corporate america. These corporations have shown they are irresponsible and untrustworthy just as the justices, and government have shown the American people. Why won’t the people of this country stand up for once and defend our country away from the ones who claim all of us to be terrorist. The truth is the USA government and corporate america are the biggest terrorist around the world. Starve the people and feed the defense budget, political whores, and corporate america. When do you propose to stand up for yourself? After you are thrown in one of the usa corporate prisons that they build more of every day? Think about it. We have nothing to fear other than fear ourselves.

One thing i wonder if anyone else noticed about this story is that the name of the parking lot is “Republic Parking Systems” with red white & blue on the sign as can be seen in the Q13Foxnews video link above. It would be interesting if the reporting would dig deeper to see if she was ever approached at any point to change the name.

This is the essence of the left-wing…stealing property under one pretext or another. In Cuba, when a farmer would refuse to give his farm to Castro it was Che Guevara’s job to schedule the farmer for the firing squad.

I wish I could remember. The foundational doctrine guiding all actions of any statist, individually or collectively(City council) is that goverment made it possible for you to acquire anything you may posse, property, education-(deny you a permit to practice) ,etc. Therefore goverment has a right to reaquire part or all of what you have come possess. They can then redistribute it to the benefit of the rest of society as they see fit.

I read through the documents linked in the article. It seems Seattle has a big road project going on downtown that is disrupting on street parking. In order to alleviate parking problems, they attempted to make deals with private lot owners to provide public parking at rates similar to on street parking. The owners would not agree to the deal, so, Seattle is exercising imminent domain over private lots in the construction area so tourists don’t get screwed by high parking rates. There were public meetings, direct contact, and newspaper notices all informing owners of the plan. Either she wouldn’t deal, or she didn’t know because she lives in Spokane. Either way, she is getting paid for her land.

governments to take private property if the land is for public use. He
said the project the city has in mind promises to bring more jobs and

You are right. You don’t want to pay parking, so you want the government to steal someone else’s private property so you can use it yourself. Yes, Seattle is a liberal city… in fact, a sanctuary city, which comes in handy if you’re illegal, have no insurance, and happen to hit the cars of both of my stepsons (separate occasions)… Washington has continued to re-elect Patty Murray, Adam Smith, Jim McDermott, and other clowns, so stealing someone’s parking lot is hardly a surprise.

  • MissV

That is not the point. How would you feel if they wanted to take your house? In this country that is theft and our politicians are bought by corporate america. We have enough idiots in the USA. A stadium for more meat heads to play football and have more tax dollars paid out for their head injuries and pain and suffering? No thank you. A school would have even been hard to justify. This belonged to the people, just like our country used to. You need to study American history and then come back on this one.

  • SeanBusmc .

Consider that Seattle elected and has reelected Patty Murray, Maria Cantwell and Jim McDermott.

    I rest my case.

  • E C

no it isn’t because what the government pays for eminent domain is not what she could get for that land had she intentionally sold it herself. it’s legalized theft, plain and simple.

  • Rodney Howard

Yes, but it was not a Government Parking lot!

  • alex

YOU and those like you are what’s wrong with this country!

  • Amichai

I agree. At 103, you’re living on borrowed time anyway. If they decided to steal my property, I’d go out with a bang.

  • caiusKeys

Progressives promise paradise then deliver… Detroit: http://www.youtube.com/watch?v=LTQFtNLvcl8

  • TDubin

It is not the city’s role to make sure “tourists don’t get screwed by high parking rates” on private property. So private citizens cannot be in the parking lot business anymore because they might charge according to market rates? Who decides what “screwed” is besides the market? Private lots are the norm where I live and they compete pretty well. If the private owner charges too much no one will park there. If the city could get more for the spots (and the private citizens are getting more) then it’s the taxpayers who are getting “screwed”.

  • MissV

Then you might want to read this article for help: At least eight states — Arkansas, Florida, Illinois, Kentucky, Maine,
Montana, South Carolina and Washington — forbid the use of eminent
domain for economic development unless it is to eliminate blight. Other
states either expressly allow private property to be taken for private
economic purposes or have not spoken clearly to the question.

Here is the article it was from:http://www.nbcnews.com/id/8406056/#.Umkp1xD-sTY

  • FEDup

You are out of your mind, Bob! This is HER PROPERTY and she has a right to keep it and use it as she wishes! Seattle is completely abusing their power here. They are STEALING – plain and simple. No matter if they give her compensation or not, they are STEALING this lot from her that she does not wish to sell. No one is required to park in her lot – if you don’t like the price she is charging, then you have the freedom to go park somewhere else!

What if your city comes to you and says they are taking your house, or car, or land, or whatever property of your’s they want just because they want to use it. Is that okay? I mean what do you need with your car anyways – you have two feet, use them! How would that make you feel?

Your logic is what is wrong with this country. Just because she is old or white or female doesn’t mean she no longer has a right to her own property. IT IS HER PROPERTY!

  • Jim Sweet

    In general, a good assumption.
Sadly, this is probably legal and a 103 year old is unlikely to last through litigation. To expect the Washington state polity to do anything about it is probably too much.

  • Kweb

No. They have to pay “just compensation.” Not saying this is right. Just saying that they do have to compensate.

  • Roy

I agree with Paul….. Eminent Domain is entirely unconstitutional. You people that sit back and say “Hey, no problem, she is getting paid for it”, are missing one very important fact: She got paid for what it is worth today, she’ll never get paid for what she and her heirs could have made from it going forward into perpetuity. That could be billions or trillions. The city of Seattle stole that land from her just as surely as if some thug put a gun in your back and stole your wallet. Wake up!

  • agreatsign

  • absinthe

There are parking lots, and then there are other parking lots. Some parking lots provide an income for their 103-year-old owners, and other parking lots provide easy pickings for “developers” and kickbacks for sleazebag politicians. Not saying, because I don’t know the details, but I get a whiff of manure here, and I don’t suspect that it is from the mules who are parked there.

Everyone is greedy. My wife wants a raise, too. Competition mostly, but other things as well, keep greed in check. Athletes, actors, CEOs, etc all have restraints and must, generally, provide services worth their pay. Corps have all sorts of plans to keep CEOs working for the stockholders – Apple recently announced a new method. In addition, if CEOs get too greedy corp raiders (e.g. Carl Ichan) takes over the company and fires management and boots the stock value. The scariest thing a CEO can hear is “Ichan is on the phone for you.”

Government is greedy too, but has fewer restraints and is thus much more abusive. They can deceive w/o recourse. My city just got caught reducing yellow light times to raise revenue and doing this increases physical danger to its citizens.

These 3 counties are packed with fatherless welfare garbage, illegals and their anchor babies, hippies, stoners, and the professional homeless/beggar demographic. The present governor is a pre-chosen leftist with a hideous speech impediment eagerly doing everything he can for this demographic to get re-elected.

Republic Parking Systems is just the company that manages the parking lot itself and contracts out with various other privately owned public parking lots in Seattle. The real story is that the City of Seattle is taking this property by abusing emiment domain, changing nothing about how it will be used, then after the fuss dies down the City of Seattle will sell the property to some of their politically connected friends to make a fortune one with a planned development. It is a scam… and the taxpayers fund it.

  • angelccorr

Saw a lot of land theft in California. One of my neighbors had several acres and the county wanted to steal it to build a park: a park that the illegals now play soccer on! I left that state because the only people who have freedom there are homosexuals, liberals, and illegals.

  • rczeranko

Agreed, that ruling was from a so-called conservative SCOTUS.

  • Glen Morgan

It is a scam from the start. Taxpayers get stuck funding the eminent domain abuse, plus the litigation over the eminent domain abuse. If the ED goes through, then taxpayers get stuck losing money on the parking lot because the City of Seattle has proven they can’t run a parking lot without losing money. Then, Seattle will sell the the property for below market rate to politically connected friends for a special subsidized development. Again, some will profit at the expense of the taxpayers…

Have you considered that the eminent domain “taking” of this property might actually be to the advantage of this 103 year old person? For example if the city were to buy the parcel out right the proceeds of sale would immediately be subject to capital gains tax or to defer paying the tax the seller would have to do a like kind exchange. However, if the City “takes” the property thorugh imminent domain the owner or his estate gets something like a 5 year deferal from capital gain tax in which to find a down leg like kind investment. Just something to think about.

Property owners forced to sell ( at a huge discount), the developer failed (bankrupt), the town lost the taxes from the home owners, no jobs were created, no buildings built, no economic improvement at all. So in this case the SCOTUS got it wrong.

Have you considered the taking of property that does not belong to you, by any other name, is theft? Have you considered that tyrannical government has no right to decide for people what is best for them? Have you considered they have deprived the person of what was rightfully theirs? Have you considered they can do this to you? Have you considered this may have been this person’s livelihood? Have you considered the government has determined that this person cannot do what they want to do with their stuff? Have you considered that the government just confiscated a private citizen’s source of income to make it public? Have you considered how stupid your original statement was?

  • MoreFreedom2

Using tax payer money for government to buy out businesses, and then turn a private business into “government” business, shows government is taxing and spending too much.

This is a loser all around. The woman loses her business and income from it. The government loses a business and individual taxpayer and instead of a business being run for a profit, government will likely run it into the ground, with an overpaid government employee that will be more interested in not working since government won’t hold him accountable. In the meantime, taxpayers are out the fair market value for the lot, and lose on future tax revenue as well.

Government doesn’t run anything well. It’s specialty is using force against citizens, rather than voluntary transactions that exist in a free market.

About as smooth as the New London, CT vs Kelo eminent domain case where homes in New London, CT were purchased via eminent domain for economic development with one hold out. The hold out, Kelo, was even charged rent after 5 years of fighting the case! Pfizer was to expand their facility and the land was to go to a developer for $1 a year to build condos, shopping district, etc. Despite all the tax breaks, the developer’s plan fell through. A settlement to the home owners was made with significant more payout, Kelo’s home was physically moved at great expense and Kelo moved elsewhere in the state. Pfizer merged with another company and pulled out of New London laying off about 1,500 workers and saving them $400 million in taxes. It cost the city $78 million to demolish the homes only to sit in a vacant lot that now is holding debris from hurricane Sandy! Complete waste of time, energy, and tax payers money. Kelo’s fight saw two city council seats taken over by Kelo supporters and the fight continues to replace the rest. The city of New London is still sore from it’s wounds. Now we’ll see if the New London Groton Sub Base will close (almost did in 2005, was saved at the last moment) also Electric Boat has a factory where they manufacture hunter killer submarines as well. If those two close, New London will have little to no jobs nor income…

Surely that line is from Karl Marx’s “Criticism of the Gotha Program” (1875)? Which Marx cribbed from Bakunin? I don’t know where you learned your Bible from, but I think that you need to go back to first base. Or even bone up on your Marxist texts.

Well tar is carbon, so the Global Warming taxes and regulations will be ridiculous and will raise the price dramatically. Transporting and storing will require specialized equipment. Make sure you have spill procedures and EPA registered plans on file.
The feathers need to be organic and humanely farm raised. Make sure you are following Bird Flu mitigation procedures and do not stress the fowl in any way. Also make sure that you do not have any toxic runoff from your poultry farm. And that you have worker protection plans in place. Also that you are not employing any illegal aliens. And be sure that you register your facility with OSHA and that all Jobsite Protection Equipment is up to date and functional.

Other than that, it’s a good plan!

The quotation originates from Bakunin. Marx stole it in his “Criticism of the Gotha Program.” But then Marx was a promiscuous plagiarist. As the old saying goes, Marx was both right and original, but when he was original, he was wrong, and when he was right, he was not original. One of the advantages of a modern American “education” — if one pays attention — is that one becomes acquainted with all of the Marxist-Leninist literature. One must read the Bible on one’s own or, if lucky, through one’s church.

Let’s see if they charge more as well. I find that private parking lots tend to be less expensive and better cared for.

Obviously Seattle didn’t think their “cut” of the parking fees were enough – THEY WANT IT ALL.

  • Rick Monday

I am not familiar with this particular case, but I will comment just on what I have read above, and reply to your comment. The city is taking his property from him. They are compensating him for this taking. If he doesn’t want to sell his property to the city for the compensation offered, he is not freely selling his property. If he doesn’t want to take advantage of any supposed tax deferrels, that is his choice. This is his lot. He may enjoy going to the parking lot every day and collect payments.
All this being said, perhaps this is the way he wants to sell his property, and this is just a scam concocted between him and the city so that he doesn’t have to pay exhorbitant taxes on the sale, I don’t know.

Armed revolt is the next logical sequence. When the courts can no longer provide a refuge from government abuse, at least that’s how it’s taught in liberal texts on how to deal “with the man”. A cornerstone to the Constitution is protection from the illegal seizure of property. If the Supreme Court upholds eminent domain in the context of using it to “improve” properties to the benefit of many over the right of a few to hold it, then the next logical remedy is armed resistance. Time for Revolution all up in this motha’**ker!

But no mention of how Republicans for decades have destroyed the lives of millions of women, children, minorities, gays, the elderly, the disabled, Muslims, and atheists in order to make Big Oil and Halliburton rich? What is the big deal at about a parking lot? The government surely has a better use for it, which is why I am sure they took it. I would not be surprised if this old goat wasn’t running it properly and the City decided that it would run it better. I am sick of people refusing to blame Republicans for all of the trouble they cause and instead find petty issues to whine about.

It is too easy to just say this is a norm of operation for liberal-socialist-communist ideological government control. But the truth is, it is a typical pattern. The people in control think they know what is best for everyone. Then any one particular persons rights are not important. And they tread over it. I have had this discussion with the wife of a high ranking KGB officer in Belarus. “You cannot trust the people to be free. You cannot trust what they will do. We have to have control over the people. Or society will be out of control.” Please tell me how this mind set is materially different from the liberal-progressive mindset in the USA?

Look-up the story of what they did on NW Market and 15th St. NW. They used eminent domain for a “monorail” station to get the property at that high-traffic intersection on the cheap. That fell through, so they sold the land. Those people had been collecting property at that intersection for decades, and had it ripped out from under them by the greedy Socialists. Sickening.

  • Chewster

Eminent domain is the taking of private land by the government for the supposed good of the public. Think of pushing a new freeway through farm country. The government is however required to pay fair market value for the taking. In most circumstances, such as freeway expansion the property owners reach a sales agreement before eminent domain comes into play. However what Seattle is doing does not make sense to take a parking lot to turn it into a parking lot.
